At ExoMagic, we are committed to protecting your privacy. We will never sell or give any of your personal information to anyone. The information we gather is used to provide better service and information to you, our customer.

Information Collection and Use

ExoMagic collects information from our users on our web site, and is the sole owner of this information. We will not sell, share, or rent this information to others different from what is disclosed in this text.


Registration

To place an order on our web site, a user must register by giving their contact information (such as name and email address). This information is used to contact the user about the services on our site for which they have expressed interest. 

Order


We request information from the user on our order form. Here a user must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). This information is used for billing purposes and to fulfill a customer's order. If we have trouble processing an order, this contact information is used to get in touch with the customer.

Cookies


A cookie is a piece of data stored on the user's hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. Once the user closes their browser, the cookie simply terminates until you return to our site. We leave a cookie on the user's machine, which will allow the site to recognize the user when they return. For instance, by setting a cookie on our site, the user would not have to log in a password more than once, thereby saving time while on our site. If a user rejects the cookie, they may still use our site, although the user will be limited in some areas of our site.

Log Files

We use IP addresses to analyze trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. 

Sharing

We will share aggregated demographic and trending information with our partners and advertisers. This is not linked to any personal information that can identify any individual person. We use an outside shipping company to ship orders, and a credit card processing company to bill users for goods and services.

We partner with parties to provide specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services.

If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address.

From time to time our site requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as ZIP code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site. 

Security


ExoMagic takes every precaution to protect our users' information. When you submit sensitive information via the web site, your information is protected both online and off-line. When you enter sensitive information (such as credit card number and/or social security number), that information is encrypted and is protected with the best encryption software in the industry - SSL. While on a secure page, such as our order form, the padlock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when you are just 'surfing'. While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect customer information off-line. All of our customers' information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific task (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. Our employees must use password-protected screen-savers when they leave their desk. When they return, they must re-enter their password to re-gain access to your information. Furthermore, ALL employees are kept up-to-date on our security and privacy practices. Finally, the servers that we store personally identifiable information on are kept in a secure environment, protected by a firewall. 

Supplementation of Information

In order for this Web site to properly fulfill its obligation to our customers, it is necessary for us to supplement the information we receive with information from 3rd party sources. 

Special Offers

We send all new members a welcome email to verify password and username. Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see our choice and opt-out below. 

Choice/Opt-out


Our users are given the opportunity to 'opt-out' of having their information used for purposes not directly related to our site at the point where we ask for the information.

Users who no longer wish to receive our newsletter or promotional materials from may opt-out of receiving these communications by choosing the un-subscribe option at the bottom of each newsletter. 

Users of our site are always notified when their information is being collected by any outside parties other than those mentioned in this privacy policy above. We do this so our users can make an informed choice as to whether or not they should proceed with services that require an outside party. 

Site and Service Updates


We also send the user site and service announcement updates. Members are not able to un-subscribe from service announcements, which contain important information about the service. We communicate with the user to provide requested services and in regards to issues relating to their account via email or phone. 

Correction/Updating Personal Information:


If a user's personally identifiable information changes (such as your ZIP code), or if a user no longer desires our service, we will endeavor to provide a way to correct, update or remove that user's personal data provided to us. This can usually be done at the My Account page, or by emailing or calling Customer Support. 

A note about web site errors.

Due to high order volume, an item may go out of stock before we're able to remove it from our site. If this happens, we will notify you personally using the phone number or email address you have provided. Also, although we make every attempt to maintain accuracy, human errors happen from time to time. We cannot honor inaccurate or erroneous price listings. If you see an error, please report it to our Support Center.

Notification of Changes


If we decide to change our privacy policy, we will post notification of those changes on our site so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.

Prices: All prices are in U.S. Dollars. Prices are subject to change and honest mistake. Our prices are very competitive, but if you find a lower price elsewhere, check out our fair price guarantee!

Overpayments: If you send us a check or money order for more than your order total, or if you obtain a credit with us, we will give you store credit for the balance on your next order. Our store credit system is automated and you will see the credit at the end of the checkout process. 

Product Descriptions: Writing product descriptions isn't half as fun as reading them! Most of the time, we copy the descriptions provided by the manufacturer. If we misrepresent a product, and you're unhappy with the item, bring it to my attention. Any bulk pricing or special offers within a product description is an accident remnant from the manufacturer and is void. 

Product Images: Our vendors provide the product images you see on our website. The product might be displayed in bulk packaging, but all prices are for one of the item. 

Privacy: Click here to review our Privacy Notice, which also governs your visit to our website. We do not share your information with third parties. 

Electronic Communications: You consent to receive communication from us electronically. You agree that all communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. 

Your Account: You are responsible for maintaining the confidentiality of your account and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion. 

Reviews and Content: Visitors may post content if it is not illegal, obscene, threatening, or defamatory. You may not impersonate any person or entity. We reserve the right (but not the obligation) to remove or edit such content. Risk of Loss: All items purchased from ExoMagic are made pursuant to a shipment contract. This means that the risk of loss for such items pass to you upon our delivery to the courier. 

Declined Payments: If for some reason your payment is declined, we will hold your order for 24 hrs. After that time, we may ship your order without confirmed payment. After thirty days, if payment is not received, we will add a 1.5% ($3.00 minimum) service charge to your total each month. You will be responsible for all fees associated with a declined payment. We may continue to attempt to charge your credit card daily. 

Disputes: By visiting our site, you agree that the laws of the state of Oklahoma will govern these Conditions of Use. Any dispute relating in any way to your visit of our site or of products you purchase through our site shall be submitted to confidential arbitration in Oklahoma. The arbitrator's award shall be binding. Your claim shall not be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise. 

Miscellaneous: Please review our other policies posted on this site. These policies also govern your visit to ExoMagic. Our Internal Policies are not binding. We reserve the right to make changes to our site and policies at any time without notice. We disclaim implied warranties of fitness for a particular purpose. That wasn't so bad was it? It's hard to write rules without sounding like a meanie! But you're the most valuable part of our business, and being open and honest with you is our top priority.

Shipping Policy

I'm convinced the shipping process is actually quite simple. When you order something, I send it to you. It needs to get there fast and safe. The following policies give us both equal protections. A good deal is one that's good for everybody or it isn't good for anybody! 

When We Ship: Instock merchandise ships the same day you place an order, providing we have payment confirmation before 2 pm (Central time) Monday through Friday, excluding federal holidays. Most orders ship within 2-3 days. Some bulky items and illusions may require special packing; please allow an extra 24 hours to process those orders. If we get busy, your order may ship the next business day. We do not guarantee shipping or delivery times. 

Delivery Times: During the checkout process, you have a choice of delivery times. Most domestic orders are delivered within 10 business days. Priority service is available for a small fee. International customers may choose an expedited means or free shipping. Expedited takes 4-10 days to reach most destinations. 

Faster Shipping: Expedited shipping rates are estimated at checkout for your convenience. If your package costs more than the price displayed, we'll contact your with the difference, minus what we agree to pay on your behalf. Should your order be placed after the cut-off time, it will be dispatched the next business day under the terms of expedited service. We can have available items that are out of stock dropshipped by our vendors! 

Canadian Orders: Previously, Canadian customers were considered International and had to pay higher shipping than customers within the continental United States. Now, Canadian ground orders are viewed as Domestic at ExoMagic. Expedited packages are still International. 

Refunds & Returns: If you are unhappy with an item for any reason, please return it within thirty days from the shipped date for an exchange or refund of the purchase price less shipping and tax (if applicable). Items shipped uninsured may not be returned if damaged! 

We reserve the right to give a refund, exchange, or store credit at our sole discretion. We do not refund shipping charges, tax, customs charges, instant downloads, grand illusions, liquidated, used, free or custom merchandise. Backorders: You will be notified if an item has suddenly become out of stock or discontinued; the balance of your order will ship immediately in most cases. You may cancel a backorder at any time! 

Where We Ship: ExoMagic has a global cast of customers, but we do not ship to every country. We do not ship to any location that has a 60% or higher fraud rate. 

Packaging: Packaging magic is an art form! It's also boxes, tape, newspaper, and foam. If we can save you money by removing excess packaging from an item, we will. For instance, we may breakdown a bulky box or compress sponge balls. 

Types of Service: Our primary couriers are UPS and The United States Post Office, depending on which is best for a specific order. But we do business with all couriers. 

Gifts: Use the comment box during the order process to make special requests for gifts. We are not required to include a packing slip on domestic orders, but must for international orders. For your convenience, packing slips do not include prices. 

International Orders: All customs duties and country taxes are your responsibility. If you require a package specially marked, please notify us in the comment box at the time you place the order. International orders may be held while we determine payment authenticity. 

Definitions: A check or money order is not confirmed until it clears the bank. We cannot send single orders to multiple addresses. Your order may be drop-shipped by our vendors. Domestic orders are those placed within the United States or Canada. All other locations are considered international. Orders are shipped in a single parcel unless we decide otherwise.

However to receive the refund/credit you must contact support via ticket within 14 days of shipment. Selected items may be excluded from this offer.

Should ExoMagic reduce its price on any shipped product within 14 calendar days of shipment, you may contact ExoMagic Sales Support via ticket to request a refund or credit of the difference between the price you were charged and the current selling price. To receive the refund or credit you must contact ExoMagic within 14 business days of shipment.
